Currently Not Collectible

If you cannot currently pay any of your tax debt due to severe financial hardship, our Tax Attorneys can temporarily delay IRS harassment by petitioning for currently not collectible status (CNC) until we can finally negotiate a settlement regarding your tax problems. Once the IRS declares a taxpayer CNC, the IRS must stop all collection action, including bank and wage levies. The IRS must send an annual statement to the taxpayer stating the amount of tax still owed. This annual statement is not a bill. While in CNC status, the 10-year statute of limitations on tax debt collection continues to run. However, if a taxpayer’s financial status improves, the IRS can remove the file from CNC status and return to active and aggressive collection status.
